These Terms serve as clear and comprehensive guide defining responsabilites and rights of all parties, promote responsible use of property, provide a framework for resolving common issues. This facilitates efficient problem-solving and contributes to a fair and secure environment for all parties.

FOR GUESTS

  • Clarity and Transparency

They establish clear expectations and outline the guest’s responsibilities throughout the rental period. This includes aspects like payment terms, occupancy limits, house rules, and proper conduct. By understanding these guidelines, guests can avoid misunderstandings and ensure a smooth and enjoyable stay.

  • Consumer Protection

They define the guest’s rights and limitations, including their entitlement to a clean and functional property, complaint procedures, and potential limitations on the host’s liability. This empowers guests to make informed choices and seek recourse if necessary.

FOR HOSTS

  • Protection of Property and Investment

They safeguard the host’s property from potential damage or misuse by outlining guest responsibilities regarding proper care and responsible use of the villa. This includes limitations on occupancy, conduct, and activities that could harm the property.

  • Financial Security

They ensure timely and complete payment by specifying rental fees, service charges, and potential consequences for late payments or cancellations. This helps hosts manage their finances and maintain the rental business’s viability.

1. GENERAL

  • Terms and Conditions („Terms“) act as a legally binding agreement between the Guest (the “Guest”) and manager or agent (“Retreat Villas”), relating to the occupation of the Host’s (the “Host”) Accommodation by the Guest in accordance with the Rental Agreement for the duration of the Rental Term for the Total Rental Fee as detailed in the Booking Confirmation.

  • This Terms constitutes the entire agreement between the Guest and Retreat Villas and any other terms, conditions or prior representations whatsoever shall be of no effect unless expressly set out in or are incorporated into this Agreement (including Rental Agreement, Cancellation Policy and House Rules).

BY CONFIRMING YOUR BOOKING AND PAYING THE ADVANCE/DEPOSIT YOU CLEARLY INDICATE THAT YOU ARE AWARE OF THE GENERAL TERMS AND CONDITIONS AND THAT YOU ACCEPT THEM.

2. PERMITION TO OCCUPY THE ACCOMMODATION

  • Subject to the Terms of this Agreement, the Host permits the Guest to occupy the Accommodation for the period stated in the Booking Confirmation for the purpose of holiday or short-term occupation.
     
  • The Host and the Guest agree that the Guest occupies the Accommodation as a licensee and that no relationship of landlord and tenant is created by this Agreement or otherwise.

3. HOST’S OBLIGATIONS

The Host agrees and confirms that:

  • the description of both the Accommodation and additional services in the Accommodation Listing is true, accurate and not misleading in any material respect;

  • the Accommodation will be clean, sanitary and free from trash on check-in with clean bedding and bathroom towels;

  • all essential appliances in the Accommodation (including all appliances referred to in the description in the Accommodation Listing) shall be in full working order together with heating and air conditioning systems where applicable or else Host will take the steps necessary to remedy the situation;

  • the Accommodation complies with applicable laws and regulations as appropriate for the Guest’s holiday or short-term occupation (including all Local Laws and European Law (as defined in the Terms of Service));
  • where required by law or local regulations, they will provide fire and health and safety guidance, which shall include information about fire exits, at least one first aid kit and fire extinguisher
  • Host should require any additional consents or pay any additional costs and/or taxes in order to grant the Guest the licence to occupy the Accommodation if needed (provided that, if necessary, the Guest has provided the Host with the relevant information);
  • they will contact the Guest trough Retreat Villas;
  • not to disclose the Guest’s identity or address to others under any circumstances, unless agreed by the Guest.

 

According to the Law in Croatia the obligation of registering tourists trough eVisitor system and paying tourist tax along with accommodation payment is prescribed under the Tourist Tax Act.

Tourist registration – The owner of a holiday home, suite or apartment is obligated to register every person staying in that accommodation within 24 hours of their arrival and deregister them as visitors on the last day of their visit. The process of registration and deregistration of tourists with the Tourism Board is performed through the eVisitor system – the central electronic system for registration and deregistration of tourists in the Republic of Croatia – following protocol for secure and accurate electronic and automatic data exchange.

The required data is on the basis of identity card information (ID), or a travel document (passport) as follows:

  • Name and Surname
  • Place, Country and Date of Birth
  • Citizenship
  • Type and number of identity document
  • Residence and Address
  • Date of check-in
  • Date of check-out
  • Gender

Tourist tax – while staying in Croatia according to Tourist Tax Act you are obligated to pay tourist tax along with accommodation payment. Total amount of the tourist tax is determined by the location of your accommodation as well as time of the year.

Tourist tax for Split-Dalmatia and Zadar County is approximately:

  • Adults (18+ years old): 8 – 10 HRK / 1,06 – 1,33 € per person per day.
  • Adolescents (12 – 18 years old): 50 % discount
  • Children under 12: exempted from paying
  • Tourist tax is included in your price.

4. THE GUEST AGREES:

  • to pay to the Host (through Retreat Villas as the Host’s collection agent) the Accommodation Charges and the Retreat Villas Service Fee together with any other fees, taxes and charges specified in the Booking Confirmation or which are otherwise notified to the Guest by the Retreat Villas;
  • to file any complaints about the condition of the property during 24-hour window from the time of arrival, after which no complaints will be accepted;
  • not to occupy the Accommodation other than as personal accommodation for holiday or short-term occupation for the time stated in Booking Confirmation;
  • not to transfer this licence to occupy the Accommodation to anyone else without the prior consent of the Host;
  • that where the Guest has booked the Accommodation on behalf of itself and one or more additional guests (“additional guests”), the Guest has made the additional guests aware of the terms of this Agreement and any House Rules applicable to the Booking and the Guest confirms that it will ensure that such additional guests will comply accordingly. If an additional guest is a minor then the Guest warrants and confirms that they are legally authorised to act on behalf of the minor;
  • that the maximum number of people occupying the Accommodation will be the number of guests stated in the Booking Confirmation even if the persons are minor children. The possibility of staying with more persons depends entirely on the goodwill of the host and he maintains the right to refuse service to the guest (in this situation it will be a deemed cancellation by the Guest and the Host’s Applicable Cancellation Policy shall apply) and/or to request additional payment for extra guests.
  • If fewer number of people occupies the space than specified in the Booking Confirmation or for a shorter amount of time than specified in the Booking Confirmation, the complete rental charge must be paid.
  • that they will observe any House Rules specified in the Accommodation Listing and/or notified to the Guest before or on arrival at the Accommodation;
  • the Host maintains the right to refuse service to the Guest if the Guest brings a pet to the accommodation. In this situation it will be a deemed cancellation by the Guest and the Host’s Applicable Cancellation Policy shall apply and Retreat Villas is not required to consider the Guest’s complaints regarding the provided accommodations or services.
  • the Guests are not allowed to smoke inside the property and are only allowed to smoke outside the property
  • to book this property the Guest have to be minimum 25 years old. Guests under the age of 18 can only check in with a parent or official guardian.
  • youth groups/parties are not allowed at the property. This is peaceful location designed to rest and recharge with quiet hours from 11PM – 7AM.
  • not to do or permit anything to be done which may be a nuisance, annoyance or disturbance to, or be abusive or discriminatory to the Host or any owner or occupier of neighboring property;
  • that they are responsible for their own acts and omissions;
  • not to conduct any illegal or immoral activity at the Accommodation (including the taking of illegal drugs);
  • not to cause or permit any damage to the Accommodation (other than reasonable wear and tear);
  • not to do or omit to do anything which could invalidate all or part of the Host’s insurance policy.
  • not to access cupboards, drawers or rooms which have been sealed with tape or locked, not to move furniture, not to bring things in pool except pool toys and pool accessories
  • The guest has the responsibility to leave the property in a clean and orderly condition before departure, this include washing dishes, disposing of trash and overall leaving the unit in a neat condition. This applies regardless of any final cleaning fee established by the property owner.
  • to contact and notify the Retreat Villas immediately upon becoming aware of anything that might put health and/or safety at risk;
  • that they will contact the Host through Retreat Villas;
  • not to disclose the Host’s identity or address to others under any circumstances, unless agreed by the Host;
  • that the Host is entitled to visit the Accommodation on prior notice (except in case of emergency) and to permit the Host (or an agent of the Host) access:
  • in the event that the Host reasonably suspects a breach of this Agreement; or
  • in order to fulfil the Host’s obligations under this Agreement (in which case the Host will try to provide the Guest with at least 24 hours’ notice); or
  • upon request of the Guest.;

5.     DAMAGE AND SECURITY DEPOSIT

  • If the Accommodation (or any part of it) or any of the Host’s personal property is damaged during the stay, beyond reasonable wear and tear, the Guest:
  • must immediately notify Retreat Villas
  • will be liable in full for the costs of that damage
  • The Guest confirms that if there is damage to the Accommodation or any of the Host’s personal property (over and above fair wear and tear) and/or if the Accommodation is heavily soiled so as to require in the Host’s reasonable opinion an industrial clean then the Host may authorise Retreat Villas to make appropriate deductions from the Security Deposit

 

6. CANCELLATION POLICY

  • GRACE PERIOD
    Guest can cancel free of charge for the first 24 hours after booking,
    excluding last-minute bookings made up to 48 hours before check-in.
  • FULL REFUND TILL 60 DAYS BEFORE
    Guest can cancel free of charge until 60 days before check-in.
  • NO REFUND WITHIN 60 DAYS
    Total price of reservation is charged within 60 days before check-in.
  • NO REFUND FOR NO SHOW
    Total price of reservation is charged if guest doesn’t show up.

7.    OVERSTAYING

  • The Guest agrees that they will vacate the Accommodation at the check-out time as detailed in the Booking Confirmation. The Guest acknowledges and agrees that if they do stay past the agreed check-out time without the Host’s consent:
  • the Guest will be in breach of this Agreement and the Host (or an agent on the Host’s behalf) can require you to leave; and
  • the Guest will pay to the Host an overstay fee

8. LIABILITY

  • The Guest acknowledges and agrees that Retreat Villas and Host shall not be liable to the Guest for:
  • the death of or injury to the Guest including additional guests or invitees to the Accommodation;
  • damage to any property of the Guest or the additional guests or invitees to the Accommodation; or
  • any losses, claims, demands, actions, proceedings, damages, costs or expenses or other liability incurred by the Guest or additional guests or invitees to the Accommodation in the exercise of the right to occupy the Accommodation under the terms of this Agreement.
  • The Host’s liability to the Guest for all losses shall not exceed the Accommodation Charges paid by the Guest for the Booking plus any fees or payments that the Guest paid for additional services when they made their Booking
